Introduction

Phoenix Equity Partners is committed to protecting the privacy of any information we hold about you and we have summarised below our policies regarding the collection, use and transfer of your personal data, the security measures we employ to protect such data and your rights and choices with regard to access or use of such data.

Use and Processing of Personal Data

We will only use the personal data that we collect from you for the purposes set out in this notice or for the purposes explained to you at the time we collect your personal data. Information we collect about you includes information gathered in the course of providing private equity advisory services, your use of this website, and your contact details such as those shared on the website or directly with our staff.

This information may include your contact details, personal address, correspondence with you and website traffic. CV information is addressed below separately.

We will use your personal data for the following:

  • to enable us to provide you with our services;
  • to contact you when necessary concerning any of our services we provide;
  • to manage our website and internal processes; and
  • we may use and analyse the information to allow us to administer, support, improve and develop our services to you.

Our Legal Basis for Processing Your Personal Data

We will only process your personal data in accordance with data protection law. Our legal basis for processing your personal data will depend upon the personal data concerned and the specific circumstances in which it was collected by us. We may process your personal data if:

  • we have your consent to do so; or
  • processing is necessary for us to carry out our contractual obligations; or
  • processing is required is required by law and we are under a legal obligation; or
  • we require your information to pursue our legitimate interests. Generally, the legitimate interest pursued by us will relate to the operation of our business, including the efficient performance and management of the services we provide or to maintain or website.

Candidate Information

We may receive CVs for vacancies that we have in our business, our portfolio companies, or for future roles that may arise through our day to day activities. We will only process this information for the purpose of:

  • fulfilment of such vacancies; and
  • contacting the candidate for insights or to provide networking opportunities to the candidate.

If we hold information about you:

  • for the purpose of fulfilment of a vacancy that we have in our business, then our lawful basis is contractual necessity and legitimate interests, where we have an interest in fulfilling vacancies in our business;
  • for the purpose of fulfilment of a vacancy with a third party, then we will only share your CV when you permit this. We will share such information on the basis of either your consent or where we have a legitimate interest to do support our connections in fulfilment of vacancies; and
  • for other purposes such as contacting you for further insights and to provide networking opportunities, we rely on our legitimate interests to process such information to further our business opportunities and to support a candidate in growth of their network of connections.

Data Security and Integrity

We use our best efforts to ensure that data is accurate, complete, current and reliable for its intended use. We use appropriate technical and organisational measures and safeguards to help protect your personal data from unauthorised access, misuse, alteration or loss. Our internal policies and procedures are designed to help ensure we safeguard the privacy and accuracy of all data we collect or process.

Disclosure of Your Information

We will not pass your information to anyone outside our group without your permission, unless required to do so by law, where we have a lawful basis to do so or if we rely on a third party supplier to support us.

To the extent that we disclose personal data to third parties, we will request that they properly protect the security and confidentiality of such information and otherwise process such data in accordance with applicable law.

We may need to transfer information about you outside of the country in which you are located. Where this is needed, we will put in place measures as required by data protection laws to ensure your personal data is protected. This may happen in case of sharing information about you to companies in our group, or to suppliers.

How Long We Keep your Data

Phoenix reviews the data it holds on a regular basis and your information will be destroyed if it is no longer required for the purpose(s) for which it was obtained. In any situation we will generally keep your personal data for no longer than 10 years.

Your Rights

You have the right to obtain access to your personal data; to have it updated or corrected if it is inaccurate or incomplete; to request that we restrict its processing or remove your data entirely from our systems.

When asked to remove a record from our database, Phoenix will retain minimal information to ensure we do not contact you or collect such information again in the future.

You may make a complaint at any time, about how we collect or use your data, to the Information Commissioner’s Office (ICO), the UK supervisory authority for data protection issues (ico.org.uk/concerns) or other relevant supervisory authority applicable to the processing of your data. We would, however, appreciate the chance to deal with your concerns before you approach the ICO or relevant supervisory authority so please contact us in the first instance, contact details are provided below.

Changes to the Privacy Notice

Phoenix reserves the right to modify or amend the Privacy Notice at any time and for any reason, as permitted by applicable law. If there are material changes to the Privacy Notice, those changes will be posted here.
